About the Receiver

Herb Donica has been practicing law for over 30 years and has an active license in Florida and inactive licenses in Colorado and Indiana.  He is also a Certified Public Accountant licensed to practice in Florida and has an inactive CPA license in Colorado.  As an attorney, he received an AV rating by Martindale-Hubbell in 2001, peer review rated “preeminent” in terms of proficiency and legal ethics.  Herb has counseled clients in the legal issues of bankruptcy, asset protection, tax planning and tax resolution, and has extensive experience in insolvency law.  He has represented clients in Chapter 7, Chapter 11 and Chapter 13 in United States Bankruptcy Court and has received much of his experience through the representation of various court appointed bankruptcy trustees.

In 2001, Herb represented V. John Brook, Jr., the then serving court appointed Chapter 7 Trustee for Mulberry Phosphates Corporation and its four subsidiaries, including Piney Point Phosphates, Inc.  Herb’s representation of Mr. Brook spanned a period of over twelve years during which he assisted Mr. Brook in the sale and liquidation of all assets of the Mulberry Phosphates consolidated group, including the assets of the Piney Point subsidiary.  The environmental issues currently associated with the operation of Piney Point arose prior to the 2001 bankruptcy of the Mulberry group and continued under the new ownership of Piney Point. Herb is acutely familiar with the environmental problems surrounding the operation of Piney Point, the specific legal, financial, and environmental issues involved, and became personally acquainted with many of the individuals, companies and governmental agencies involved in the situation.
